31 Dec Law Review: What is a conflict of interest?
Conflicts of interest pop up in every facet of professional and personal life. The best example Anthony can think of on a grand scale are the Canadian and Australian Prime Ministers. They have conflicts of interest, because they swear loyalty to both the people and the crown of England. Money that goes to the crown should go to the people, because there are broken roads and helpless people in both Canada and Australia. The Prime Ministers have conflicts of interests and should dump the crown for the people.
Conflicts of interest is defined as a situation in which the concerns or aims of two different parties are incompatible. In a car crash case, an attorney cannot represent both the at-fault driver and his or her passenger, because the passenger was hurt by the at-fault driver. The attorney must represent either the driver or the passenger, not both. If there are multiple vehicles with multiple passengers and disputed liability, conflicts do spring up.
